Allergen Policy for MyStr33t

Purpose of this Policy

MySt33t understands the importance of adhering to allergy and dietary requirements and has put together this policy to help users of our app to mitigate against buying or receiving food containing allergens users are sensitive or allergic to.

This policy is incorporated by reference into the terms of use for consumers and terms of use for Merchants [provide links if you can] (the “Terms”) and should be read in conjunction with such Terms. Capitalised terms used in this Policy not defined here shall have the same meaning as in the Terms.

This policy may be updated from time to time in line with changes in food safety legislation. [While we will do our best to notify you of any changes to the policy], we recommend that you check this page regularly to be kept up to date.

Common Allergens

The most common allergens are:

  • Cereals containing gluten, (i.e. wheat, rye, barley, oats, spelt, kamut or their hybridized strains) and products thereof

  • Crustaceans and products thereof

  • Eggs and products thereof

  • Fish and products thereof

  • Peanuts and products thereof

  • Soybeans and products thereof

  • Milk and products thereof (including lactose)

  • Nuts i.e. almonds, hazelnuts, walnuts, cashews, pecan nuts, Brazil nuts, pistachio nuts, macadamia nuts and Queensland nuts and products thereof

  • Celery and products thereof

  • Mustard and products thereof

  • Sesame seeds and products thereof

  • Sulphur dioxide and sulphites at concentrations of more than 10 mg/kg or 10 mg/litre expressed as SO2.

  • Lupin and products thereof

  • Molluscs and products thereof

People may report allergies to other foods not on the above list. Most common in the UK are kiwi, peas, other legumes (beans etc), other seeds and other fruits and vegetables, nightshade produce. In some cases, people only need to avoid these when raw and can have them cooked.

Letting us know about any allergies you may have

When you register to use our App, you will be asked to complete details around any allergens you are unable to consume. If there are allergens not on the list provided, please use the [Other comments] box provided on your profile to list anything else you are allergic to.

If there is a change in your allergies, you should update your profile details as soon as possible to avoid any risk of a reaction occurring. Our app does not remind you of this each time you log in so it is your responsibility to keep these details updated.

How our Merchants may deal with your allergy information

Our Merchants will be passed on any allergy information you complete on your profile. [Any changes or updates to this section of your profile] will automatically be passed on to the Merchants with each purchase you make].

Our Merchants are responsible for putting in place and implementing their own allergen policy, especially for any foods they may prepare on site or sell unpackaged. Any questions on foods and allergens should be directed to the Merchants via the app.

Mystr33t Responsibilities

MyStr33t is not in a position to guarantee a completely allergen free experience, rather to minimise the risk of exposure and encourage self-responsibility between users and Merchants.

MyStr33t is not responsible for checking Merchants are accurately labelling or selling products in respect of allergens used. Nor is MyStr33t responsible for ensuring each user has accurately completed his or her profile with respect to allergens. MyStr33t, therefore, accepts no liability or responsibility in respect of any reaction or failure to declare allergens or purchases made that later transpire to contain allergens. Any right of recourse a user has must be taken up directly with the relevant Merchant.

What should you do when buying Items from MyStr33t?

This policy encourages self-responsibility and as such requests every user of our app to observe the following:

  1. Complete and keep the user profile updated at all times;

  2. In case of any doubt when purchasing an Item via our app, contact the Merchant and ask all questions relating to ingredients, production facilities, cross contamination and labelling that are relevant to you PRIOR to making any purchase;

  3. In the event that upon collection of Item(s), you notice that there is in fact an allergen in the product you have bought to which you are allergic, you should let the Merchant know immediately and request the Merchant initiate a refund in accordance with the Terms of use of our app.

  4. In the event, the presence of a pre-notified allergen is identified after you have collected and paid for an item and before you have opened or consumed the related Item, please contact [us].
